关于部分战争风险的“撤销保险通知”

As a result of the evolving situation between Russia and Ukraine, and the impact that the conflict has had on the global reinsurance market, the Club has received a Notice of Cancellation from reinsurers in respect of certain war risk exposures. Consequently, the Club regrettably needs to issue a corresponding Notice of Cancellation to Members, which is hereby given on December 23, 2022, and will come into force with effect from 00:00 hours GMT on January 1, 2023.

Please note that this Notice is in respect of non-mutual business, including, but not limited to Charterers Liability, Fixed Premium P&I cover, and Non-Poolable extensions and ancillary covers to mutual entries.

This Notice does not apply to mutual entries for P&I and FD&D cover.

Upon expiry of the Notice at 00:00 hours GMT on January 1, 2023, cover under the above extensions will automatically be reinstated with the following terms incorporated in respect of war risks:

Territorial and Conflict Exclusion Clause

This policy excludes all loss, damage, liability, cost or expense:

(a) caused by or arising from or in connection with any Russia-Ukraine conflict and/or any expansion of such conflict; or

(a) 任何由俄乌冲突或该冲突的扩张所引起的或与之相关的；

(b) in any area or territory or territorial waters where Russian armed forces, Russianbacked forces, and/or Russian authorities, are engaged in conflict within the territories (including territorial waters) of the Russian Federation, Belarus, Ukraine and any disputed regions of Ukraine, the Crimean Peninsula, and the Republic of Moldova.

(b) 任何在俄罗斯武装部队、俄罗斯支持的部队或俄罗斯当局在俄罗斯联邦、白俄罗斯、乌克兰和乌东争议地区争议地区、克里米亚半岛和摩尔多瓦共和国的领土（包括领水）发生冲突的地区、领土或领水内发生的；

(c) arising from capture, seizure, arrest, detainment, confiscation, nationalisation, expropriation, deprivation or requisition for title or use, or the restraint of movement of vessels and cargo in the territories (including territorial waters) of the Russian Federation, Belarus, Ukraine and any disputed regions of Ukraine, the Crimean Peninsula, and the Republic of Moldova.

(c) 在俄罗斯联邦、白俄罗斯、乌克兰和乌东争议地区、克里米亚半岛和摩尔多瓦共和国的领土(包括领水)内，因捕获、扣押、逮捕、拘留、没收、国有化、征用、剥夺或征用所有权或使用权，或限制船舶和货物的转移而引起的；

#1 Notice of Cancellation (“Notice”)

#1 撤销保险通知（以下简称“通知”）

Where this policy insures liability, loss, damage, cost, or expense caused by, arising out of or in any way connected with one or more of the following risks:

由以下一种或多种风险引起的或以任何方式与之相关的责任、损失、损害、成本或费用：

1.1 war, civil war, revolution, rebellion, insurrection, or civil strife arising therefrom, or any hostile act by or against a belligerent power;

1.2 capture, seizure, arrest, restraint, or detainment, and the consequences thereof or any attempt thereat;

1.3 derelict mines, torpedoes, bombs, or other derelict weapons of war;

1.4 strikes, locked-out workmen, or persons taking part in labor disturbances, riots or civil commotions;

1.5 terrorism, or any person acting maliciously or from a political motive;

1.6 confiscation, nationalization, expropriation, deprivation or requisition.

1.1 战争、内战、革命、叛乱、暴动，或由此引起的内斗，或交战国的任何敌对行为；

1.2 捕获、扣押、逮捕、限制或扣留，以及其后果或试图的威胁；

1.3 废弃的水雷、鱼雷、炸弹或其他废弃的战争武器；

1.4 罢工、被困工人，或参与劳工骚乱、暴乱或民间骚乱的人；

1.5 恐怖主义，或任何恶意或有政治动机的人；

1.6 没收、国有化、征用、剥夺或占用。

This policy may be cancelled in respect of these risks only by the Club giving 72 hours’ notice of cancellation (hereinafter “Notice”) with Notice being effective from midnight Greenwich Mean Time on the day Notice is given.

对于这些风险，只有在协会提前72小时发出撤销保险通知（以下简称“通知”）的情况下才能取消承保，从发出通知的当天格林威治时间的午夜起算。

The Club may subsequently agree to reinstate cover, if required, on terms to be agreed by the Club. Any reinstatement of cover shall occur at a time to be agreed by the Club.

如果需要，协会可以随后同意恢复保险，相关条款需经协会同意。任何保险的恢复应从协会同意的时间起算。

#2 Automatic Termination

#2 自动终止保险

2.1 Whether or not the notice of cancellation described in clause 1 has been given, this insurance shall TERMINATE AUTOMATICALLY:

2.1 无论是否已发出第1条所述的撤销保险通知，以下情况本保险将自动终止：

2.1.1 upon the occurrence of any hostile detonation of any nuclear weapon of war, wheresoever or whensoever such detonation may occur, and/or;

2.1.1 在发生任何战争核武器的敌对性引爆时，无论这种引爆发生在何时何地；

2.1.2 upon the outbreak of war (whether there be a declaration of war or not) between any of the following countries: United Kingdom, United States of America, France, the Russian Federation, the People's Republic of China

2.1.2 在以下任何国家之间爆发战争（无论是否宣战）时：英国、美国、法国、俄罗斯、中国。
